These General Terms & Conditions govern the sale of ferry reservations and related travel products by St Barth Ferry LLC, through StBarthFerry.com. They are effective from 15 February 2023 and should be read together with our Privacy Policy below.

This page is provided for customer transparency and operational protection. Nothing on this page limits or excludes any rights that cannot be limited or excluded under applicable law. If you have a concern about a booking or a charge, please contact us before filing a payment dispute.

StBarthFerry.com sells electronic ferry reservations and may act as a booking agent or reseller for independent transportation operators.

Operator control

The transport service is provided by the carrier named on the ticket. Operators control schedules, boarding, check-in rules and refund authorization.

Refund limits

Reservations are non-refundable unless specifically authorized by the operator. Any authorized refund is subject to a 20% service charge.

Privacy rights

We collect and process personal information only as needed to provide travel services, process payments, comply with law and protect the business.

Important refund notice

Great Bay Express (Blue Peter Charters N.V.) no-refund policy

Tickets issued for transportation operated by Blue Peter Charters N.V., doing business as Great Bay Express, are non-refundable unless written authorization is provided directly by Great Bay Express or unless a refund is otherwise required by applicable law. StBarthFerry.com cannot override the refund policy of Great Bay Express. When a customer purchases a Great Bay Express ticket through StBarthFerry.com, the customer agrees that StBarthFerry.com may be obligated to pay the operator even if the customer later files a payment dispute or chargeback.

Applies to Great Bay Express

This highlighted no-refund policy applies specifically to transportation operated by Blue Peter Charters N.V. dba Great Bay Express. Other operators may complete payment and refund handling through their own procedures.

Written authorization required

A refund for a Great Bay Express ticket generally requires written approval from the operator. Verbal statements, customer preference, missed travel or changed plans do not automatically qualify.

Fair review still applies

StBarthFerry.com will review genuine hardship, operational failure, duplicate charges, manifest errors and other legitimate issues in good faith, even where doing so creates cost to the business.

General Terms & Conditions

The Articles that govern your booking

By using this website or purchasing a travel product, you confirm that you have reviewed the booking details — passenger information, route, operator, travel date and travel time — and that you accept the Articles below before payment.

Article 1.1 — Electronic reservation & e-ticket

The product offered is an electronic ferry reservation, which may include an e-ticket depending on the specific route's policy. The client is responsible for complying with all check-in requirements. Refunds are granted at the seller's discretion, subject to operator authorization.

Article 1.2 — Client responsibilities & disputes

By making a reservation, the client waives the right to initiate a credit card dispute against the seller and agrees to compensate the seller for any losses incurred due to such disputes within 15 days. The client also waives any rights afforded under domestic or foreign credit or agency legislation, except to the extent such rights cannot be waived under mandatory applicable law.

Article 1.3 — Non-refundable tickets

All reservations are non-refundable unless specifically authorized by the operator. Refund requests must be confirmed directly by the ferry operator.

Article 1.4 — Service charge on refunds

Where a refund is authorized, any refund issued is subject to a 20% service charge.

Article 1.5 — Passport & visa requirements

The buyer is responsible for meeting all passport and visa requirements for entry into any port of call. Failure to meet these requirements does not qualify for a refund.

Articles 2 & 3 — Formation of the contract

These conditions govern the sale of travel tickets via the St Barth Ferry website. A contract is established upon successful payment, and a confirmation is sent to the buyer's email; tickets include relevant port and luggage fees. If electronic payment is incomplete, the purchase is voided. Tickets must be presented in printed form together with valid identification at the check-in desk.

Article 4 — Carrier & force majeure

The transport service is provided by the carrier named on the ticket. Where multiple carriers are involved, all names will be listed. St Barth Ferry is not liable for damages due to force majeure or events beyond its control.

Article 5 — Timetables & prices

Timetables and prices are updated regularly but cannot be guaranteed. Customers are advised to confirm departure times 12 hours prior to travel. Minor changes and delays may occur, and St Barth Ferry will notify customers of any significant changes.

Article 6 — Booking cut-off

Tickets can be purchased online up to 2 hours before departure, subject to carrier and occupancy conditions.

Article 7 — Refund & re-booking window

Refunds are possible under specific conditions and must be requested at least 48 hours prior to departure. Non-refundable and non-amendable tickets are clearly marked. Re-booking is possible up to 24 hours prior to departure.

Article 8 — Prices, service fee & payment

Information on travel ticket prices is available on the website. An online service fee of 20% per ticket applies. Payments can be made using Maestro, MasterCard or Visa.

Articles 10 & 11 — Changes & effective date

St Barth Ferry reserves the right to change these terms in accordance with its business policies and legal obligations. These terms are effective from 15 February 2023 and are available on the website. Customers retain any mandatory rights that cannot be waived under applicable consumer, payment-card, data-protection or travel laws.

Article 12 — Secure payments (3D Secure)

St Barth Ferry provides secure online shopping through 3D Secure authentication on supported cards.

Article 13 — Bookings via partners

Tickets purchased via partners are subject to that partner's terms and conditions. St Barth Ferry is not liable for cancellations or errors made by partners.

Article 14 — Passenger luggage & liability

Luggage, packages & limitation of liability

All luggage, personal effects, baggage, parcels and any other items brought on board by the Passenger travel entirely at the Passenger's own risk. Go Fast Ferry LLC and StBarthFerry.com shall not be responsible or liable for loss, theft, delay, misdelivery, damage, deterioration or destruction of any luggage or packages — whether carried by the Passenger, stored in designated areas, placed in cargo holds or handled by crew members — except where liability cannot be excluded under mandatory applicable law.

Passengers remain solely responsible for the supervision, handling, packing and security of their luggage and packages at all times, including during embarkation, disembarkation and transit. No declaration of value shall be accepted, and no special custody or safekeeping agreement shall be implied or created, whether expressly or tacitly.

To the fullest extent permitted under applicable United States maritime law, including general maritime principles, and European Union and French maritime law — including but not limited to Regulation (EU) No 1177/2010 and the French Transport Code — Go Fast Ferry LLC and StBarthFerry.com exclude any liability for indirect, incidental or consequential damages relating to luggage or packages, including but not limited to loss of use, financial loss or personal inconvenience.

Nothing in this Article shall exclude or limit liability for death or personal injury resulting from gross negligence or willful misconduct where such exclusion is prohibited by mandatory law. In jurisdictions where limitation of liability is required, any liability shall be limited to the minimum amount prescribed by the applicable maritime conventions, statutes or regulations.

By purchasing a ticket and boarding the vessel, the Passenger expressly acknowledges and accepts this allocation of risk regarding luggage and packages, in accordance with standard ferry transport practices and maritime transport protocols.

Refunds and cancellations

How refunds are handled

Refund eligibility depends on the operator involved, the timing of the request and any written authorization received from the operator. St Barth Ferry reviews requests in good faith but cannot guarantee a refund where the operator's policy does not allow one.

Non-refundable by default

All reservations are non-refundable unless specifically authorized by the ferry operator.

Operator authorization

Refund requests must be confirmed directly by the operator. StBarthFerry.com cannot override an operator's refund policy.

48-hour request window

Where a refund is possible, it must be requested at least 48 hours prior to departure. Re-booking is possible up to 24 hours prior to departure.

20% service charge

Any authorized refund is subject to a 20% service charge. The 20% online service fee per ticket may be non-refundable once a booking has been processed.

Payment disputes and chargebacks

Please contact us before filing a bank dispute

By making a reservation you agree to contact StBarthFerry.com and allow a reasonable opportunity to investigate before initiating a payment dispute, chargeback or bank claim, and to compensate the seller for losses caused by an unjustified dispute within 15 days. This helps us verify the booking, contact the operator, review the facts and attempt a fair resolution.

Filing a chargeback does not automatically cancel your obligations under these terms or the operator's policy. StBarthFerry.com may submit evidence to the payment processor, issuing bank, operator and dispute reviewer to show that the booking was authorized, issued, delivered or subject to a disclosed non-refundable policy. Nothing here limits mandatory payment-card rights that cannot be waived under applicable law.
